Terms of Service

Welcome to FARWEST PAYMENT PTY LTD. (“Provider”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your use of our payment processing services (“Services”) provided to merchants (“you”, “Merchant”).

By using our Services, you agree to these Terms.

1. Services Provided

  • We facilitate payments from your customers (“Pay-ins”), manage payouts (“Pay-outs”), and handle settlement of funds to your designated bank account.
  • We provide APIs and software to enable real-time transaction processing and reporting.
  • Settlements will be made according to agreed schedules and currencies.

2. Your Obligations

  • You agree to integrate our software and follow the technical specifications provided.
  • You must comply with all applicable laws, regulations, and maintain fraud prevention measures.
  • You must promptly notify us of any suspected security breaches, fraud, or misuse related to your account or transactions.

3. Fees and Payments

  • Service fees will be deducted from your transaction funds as per the agreed fee schedule.
  • In case of discrepancies, we will provide evidence supporting fee calculations.

4. Confidentiality

  • Both parties will keep confidential information private and use it only for purposes of providing the Services.
  • Confidential information includes business, financial, and customer data shared between us.
  • Confidentiality obligations survive termination for one year.

5. Liability

  • We are responsible for providing the Services with reasonable care and skill.
  • Neither party is liable for indirect, special, or consequential damages.
  • You understand that financial third parties involved are managed by us, and we hold responsibility for their actions.

6. Term and Termination

  • The Agreement is effective from the date you accept and continues for 12 months, automatically renewing yearly unless terminated by either party with one month’s written notice.
  • Either party may terminate immediately for material breaches or insolvency events.

7. Intellectual Property

  • We grant you a limited, non-exclusive license to use our software solely to access and use the Services.

8. Changes to Terms

  • We may update these Terms from time to time and will notify you of material changes.
